Terms of Service 

By accessing, booking, or using services through NRGY Studios Ltd. (“NRGY Studios,” “we,” “our,” or “us”), including our mobile application (powered by Mariana Tek) and in-studio services, you agree to be bound by the following Terms of Service. 

1. Acceptable Use Rules (App & Services) 

Users agree to use the NRGY Studios app and services for lawful purposes only. You may not: 

  • Misuse the booking system (e.g., booking classes without intent to attend or repeatedly late cancelling) 

  • Share, transfer, or allow others to use your account, credits, or membership 

  • Attempt to interfere with or disrupt the app’s functionality or security 

  • Use the platform for fraudulent, abusive, or harmful activity 

  • Harass, threaten, or harm staff, instructors, or other members (in person or digitally) 

NRGY Studios Ltd. reserves the right to monitor usage and restrict or terminate access for misuse. 

2. User Obligations 

By using our services, you agree to: 

  • Provide accurate, current, and complete personal information 

  • Maintain and update your account information as needed 

  • Maintain a valid credit card on file for all bookings and memberships 

  • Follow all studio policies, class guidelines, and instructor directions 

  • Arrive on time for scheduled classes (late entry may not be permitted) 

Failure to comply with studio policies or provide accurate information may result in suspension or termination of your account, memberships, or class credits at the sole discretion of NRGY Studios Ltd. 

3. Booking, Waitlist & Cancellation Policies 

  • All class bookings are managed through the Platform 

  • If a class is full, you may join the waitlist 

  • If a spot becomes available, you may be automatically added to the class and notified via the Platform 

  • It is your responsibility to monitor your booking and waitlist status 

Cancellation Policy: 

  • Classes must be cancelled within your applicable 12-hour or 6-hour cancellation window, dependant on the membership or credit type 

  • Late cancellations or no-shows will result in a penalty (loss of credit and/or fee depending on your membership or credit type) 

Repeated violations may result in account restrictions. 

4. Intellectual Property Rights 

All content, branding, logos, class formats, materials, and digital assets are the exclusive property of NRGY Studios Ltd. 

Users may not copy, reproduce, distribute, modify, or use any materials without prior written consent. 

5. Payment & Billing Terms 

  • A valid credit card is required to book classes or hold memberships 

  • Credit cards on file will be charged within 24 hours of the first use of a credit or activation of a membership (i.e., attendance at a class). 

  • Memberships are billed on a recurring monthly billing cycle 

  • Refunds, where applicable, will be processed within 1–2 business days. 

  • Cancellation fees will apply for late cancellations or missed classes outside of the applicable 12-hour or 6-hour cancellation window, depending on the membership or credit type selected 

All purchases are subject to these terms at the time of booking. 

6. Limitation of Liability (Fitness Participation) 

By participating in any classes, programs, or services offered by NRGY Studios Ltd., you acknowledge that physical exercise involves inherent risks, including but not limited to injury, illness, or property damage. 

You agree that: 

  • You voluntarily participate in all activities at your own risk 

  • You are physically capable of engaging in fitness activities and have consulted a healthcare professional if needed 

  • NRGY Studios Ltd., its owners, instructors, employees, and affiliates shall not be held liable for any injuries, damages, losses, or claims arising from participation in classes, use of facilities, or use of the app 

To the fullest extent permitted by law, NRGY Studios Ltd. disclaims all liability related to fitness participation. 

7. Dispute Resolution 

In the event of any dispute, claim, or disagreement arising from the use of NRGY Studios Ltd. services: 

  • Both parties agree to first attempt to resolve the matter informally through direct communication 

  • If a resolution cannot be reached, disputes shall be handled in accordance with the laws of the Province of Ontario, Canada 

  • Any legal proceedings must be brought exclusively within Ontario courts 

By agreeing to these terms, you waive the right to participate in class-action lawsuits against NRGY Studios Ltd. 

8. Termination Conditions 

NRGY Studios Ltd. reserves the right to suspend, cancel, or terminate a user’s account, membership, or access to services at any time, without refund, for reasons including but not limited to: 

  • Violation of these Terms of Service or studio policies 

  • Disruptive, abusive, unsafe, or inappropriate behavior toward staff or members 

  • Fraudulent activity or misuse of memberships or credits 

  • Repeated late cancellations or no-shows 

Users may also terminate their membership in accordance with the cancellation policy outlined at the time of purchase. 

9. Age Requirements 

  • Users must be at least 16 years of age to independently access and use NRGY Studios services 

  • Individuals aged 12–16 may participate only if accompanied by a parent or legal guardian 

10. Platform Disclaimer 

NRGY Studios Ltd. utilizes a third-party booking system powered by Mariana Tek. While we strive to ensure accuracy and reliability: 

  • We are not responsible for technical errors, outages, or delays caused by the Platform 

  • Users are responsible for managing their bookings and notifications within the app 

11. Modifications to Terms 

NRGY Studios Ltd. reserves the right to update or modify these Terms of Service at any time. Continued use of services after changes constitutes acceptance of the revised terms.
